1. Agreement to Terms

These Master Terms of Service (“Terms”) form a binding agreement between you (“you” or “User”) and ImgNova (“we”, “our”, or “Company”) governing your access to and use of ImgNova’s website, APIs, applications, AI models, and other services (collectively, the “Service”). By accessing or using the Service, you accept and agree to be bound by these Terms.

2. Scope of Service

ImgNova provides generative AI capabilities including image, video, and audio generation, editing tools, and character chat. The Service may integrate third-party models and providers to deliver functionality (e.g., VEO-3, FLUX.1, SDXL). We may add, remove, or modify features at any time.

3. Account Eligibility & Registration

You must be 18 years or older to use the Service. When creating an account you agree to provide accurate information and maintain the security of your credentials. You are responsible for all activity that occurs under your account.

4. Generated Content & Ownership

Subject to your compliance with these Terms, ImgNova assigns to you all right, title, and interest in outputs produced by the Service from your prompts ("Generative Output"). You are responsible for ensuring that your use of Generative Output does not infringe any third-party rights or violate laws.

We may use Generative Output in anonymized, aggregated form to improve our Service, unless you explicitly opt out of such usage where the option is provided. ImgNova may retain limited copies of content for safety, moderation, or to provide functionality (e.g., your gallery) consistent with our Privacy Policy.

5. Acceptable Use & Prohibited Conduct

Users must not use the Service to create or distribute content that is unlawful, abusive, harassing, defamatory, pornographic, sexualizes minors, violent, hateful, or fraudulent. Specifically prohibited actions include:

• Generating sexual content involving minors (real or simulated).
• Producing CSAM, non-consensual explicit imagery, or revenge porn.
• Generating disallowed extremist or terrorist content.
• Creating content that infringes copyrights or trademarks.
• Attempting to bypass moderation, rate-limits, or security controls.

Violations may result in removal of content, suspension, or termination of accounts, and we reserve the right to report illegal activity to authorities when required.

6. Payment, Licensing & Merchant of Record

Payments for paid offerings are processed by our Merchant of Record, Lemon Squeezy. Billing inquiries are handled by Lemon Squeezy. Lifetime purchases are non-transferable one-time licenses unless otherwise stated.

7. Refund Policy

Refunds are governed by the Refund & Cancellation policy below and by Lemon Squeezy’s buyer terms. Requests must be submitted within the stated refund window; excessive usage or abuse may disqualify refund eligibility.

8. Disclaimers & Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, IMGNOVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

IN NO EVENT SHALL IMGNOVA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNT PAID BY YOU TO IMGNOVA IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless ImgNova and its officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Service.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms shall be resolved by arbitration in Hyderabad, India under the Arbitration and Conciliation Act, 1996, unless otherwise agreed in writing.

12. Changes to Terms

We may update these Terms periodically. Material changes will be posted with an updated effective date. Continued use of the Service after changes constitutes acceptance.

ImgNova is committed to protecting your privacy. This policy describes what personal data we collect, how we use it, with whom we share it, and the choices you have regarding your data.

1. Data We Collect

1.1 Data You Provide

• Account data: email, username.
• Transactional data: purchase history (processed via Lemon Squeezy).
• Content inputs: prompts, uploaded files, generation parameters (processed to generate output).

1.2 Data Collected Automatically

• Technical data: IP address, device, browser, OS.
• Usage data: logs, analytics, performance metrics.
• Cookies: session and analytics cookies (see Cookie Policy).

2. How We Use Data

• To provide and maintain the Service.
• To process payments and prevent fraud.
• For security, abuse detection, and legal compliance.
• To communicate with you (support, notices, updates).

3. AI Training & Usage

We do not use your private prompts, uploads, or generated outputs to train our public foundational models unless you explicitly opt in to a feedback or improvement program. Temporary processing is necessary to generate outputs; we may retain limited copies for safety, support, and moderation consistent with this policy.

4. Sharing & Subprocessors

Data is shared only with trusted subprocessors (e.g., cloud providers, Lemon Squeezy for payments, analytics providers). Subprocessors are contractually required to protect personal data.

5. International Transfers

Your data may be transferred to and processed in countries outside your residence. We use appropriate safeguards such as Standard Contractual Clauses (SCCs) where required.

6. Retention

We retain personal data as long as necessary to provide the Service, comply with legal obligations, or resolve disputes. Content (prompts, uploads, outputs) is not retained for training unless you opt in.

7. Your Rights

Subject to applicable law, you have rights to access, correct, delete, and port your personal data. To exercise these rights contact: privacy@imgnova.art.

Refunds are processed by Lemon Squeezy and handled in accordance with their policies and the guidelines below.

Refund Window

Refund requests should be submitted within 14 days of purchase. Refund eligibility is evaluated case-by-case. Excessive usage may affect eligibility.

How to Request

Email support@imgnova.art with your Lemon Squeezy order ID and a brief reason for the request. Do not file a chargeback without contacting support first — chargebacks may lead to account suspension.

Chargebacks

Unilateral chargebacks without attempting support resolution may result in permanent account termination and loss of access to the service.

We use cookies to ensure the site works correctly and to collect anonymous analytics to improve the product.

Types of Cookies

• Essential cookies: required for login and security.
• Performance & analytics: anonymous usage statistics.
• Payment cookies: used by Lemon Squeezy during checkout.

Managing Cookies

You can disable non-essential cookies in your browser; however, this may reduce functionality. The site includes a cookie consent banner to accept or decline non-essential cookies.

The AUP defines permitted and prohibited actions when using ImgNova. Use the Service responsibly and lawfully.

Prohibited Uses

• Producing child sexual abuse material (CSAM), sexualized images of minors, or content sexualizing minors.
• Creating non-consensual explicit images or revenge porn.
• Generating content intended to harass, defame, or incite violence.
• Reverse engineering or scraping the API or website resources.
• Automated abuse, bot attacks, or attempts to circumvent rate limits.

Enforcement

We act on reports and automated detection. Enforcement actions include warnings, content removal, suspension, or account termination.

ImgNova follows industry best practices to reduce harm and promote safe use of generative AI.

Safety Controls

• Prompt filtering: Pre-processing to block disallowed content.
• Output moderation: Post-processing to detect and remove unsafe outputs.
• Manual review: Human moderation of flagged content.
• Reporting: Users may report unsafe outputs to support@imgnova.art.

Watermarking & Traceability

Where feasible, ImgNova may apply invisible or visible watermarking techniques to generated outputs to assist identification of synthetic content.

If you believe content on ImgNova infringes your copyright, please send a notice to dmca@imgnova.art with the following:

1. Identification of the copyrighted work.
2. Identification of the infringing material and its URL.
3. Your contact information (address, phone, email).
4. A statement of good-faith belief that use is unauthorized.
5. A statement under penalty of perjury that the information is accurate.
6. Your electronic or physical signature.

We will respond promptly and process valid DMCA notices in accordance with applicable law.

For enterprise customers requiring a formal DPA, please contact legal@imgnova.art. For standard users, the following summarizes our commitments:

• Scope: We act as a processor for customer personal data to provide the Service.
• Security: TLS 1.3 in transit and AES-256 at rest for stored personal data.
• Subprocessors: We use trusted subprocessors (cloud providers, Lemon Squeezy) under contractual safeguards.
• Data subject rights: We support access, correction, deletion, and portability requests as required by law.
